The Learner Travel (Wales) (Amendment) (EU Exit) Regulations 2019
EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations are made in exercise of the powers conferred by paragraph 1(1) of Schedule 2 to the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the United Kingdom from the European Union.
The Learner Travel (Wales) Measure 2008 requires seat belts to be fitted on buses used for learner transport. These Regulations amend a reference to European Union law in a provision stating that the requirement to fit seat belts does not affect any technical standard which would otherwise apply by virtue of certain enactments.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

The Welsh Ministers, in exercise of the powers conferred by paragraph 1(1) of Schedule 2 to the European Union (Withdrawal) Act 2018([1]), make the following Regulations.
The requirements of paragraph 4(2) of Schedule 7 to that Act (relating to the appropriate National Assembly for Wales scrutiny procedure for these Regulations) have been satisfied.
Title, commencement and application
1.—(1)(1) The title of these
Regulations is the Learner Travel (Wales) (Amendment) (EU Exit)
Regulations 2019.
(2) These Regulations come into force on exit day.
(3) These Regulations apply in relation to Wales.
Amendment of the Learner Travel (Wales) Measure 2008
2. In section 14A(5) of the Learner Travel (Wales) Measure 2008([2]), for “directly applicable requirement of European Union law” substitute “requirement of retained direct EU legislation”.
